Can I sue the dog breeder if I purchased a 3 mth old boxer who was diagnosed with cryptorchidism.?

He was also diagnoised with a grade 2 heart mumor. We did not sign a contract and have only had the dog 33 days. If not sue, what type of recourse can I take?
